  • Siti web e applicazioni mobili (es. e-commerce, e-book)

  • Servizi bancari online

  • Piattaforme per i trasporti pubblici

  • Sistemi di comunicazione elettronica e media audiovisivi

Imprese Obbligate

In particolare:

  • PMI (Piccole e Medie Imprese): meno di 250 dipendenti e fatturato ≤ 50 milioni di euro o bilancio ≤ 43 milioni di euro;

  • Hanno meno di 10 dipendenti;

Guidelines on Service Accessibility issued by AgID (Agency for Digital Italy)

Based on the Guidelines on Service Accessibility issued by AgID, in implementation of Legislative Decree No. 82/2022, the following is a summary of accessibility obligations, exemptions, and deadlines.

Who Must Comply with Accessibility Requirements by June 28, 2025

Starting from June 28, 2025, service providers (natural or legal persons offering services on the EU market) must ensure that their services comply with accessibility requirements.

Any provider operating in the specified sectors (electronic communications, e-commerce, banking, transport, e-books) with 10 or more employees, or an annual turnover/balance sheet exceeding €2 million, is required to make their services accessible by this deadline.

Sectors and Services Covered

The obligations apply to the following areas:

  • Electronic communication services (excluding machine-to-machine transmission);

  • Services providing access to audiovisual media, such as Electronic Program Guides (EPG);

  • Consumer banking services, including credit agreements, payment services, electronic money, and other financial services;

  • E-commerce services, i.e., distance services provided through websites and apps to conclude consumer contracts;

  • E-books and related software for usage (the obligations may apply to publishers or other involved operators);

  • Specific elements of passenger transport services, including air, bus, rail, waterway, urban, and suburban transport.

Obligated Businesses

All service providers on the EU market must comply with the requirements, except for microenterprises.

Specifically:

  • SMEs (Small and Medium-sized Enterprises): companies with fewer than 250 employees and annual turnover ≤ €50 million or annual balance sheet ≤ €43 million;

  • Large Enterprises: companies exceeding SME thresholds. If the average turnover over the last three years exceeds €500 million, administrative penalties may apply—up to 5% of turnover for non-compliance.

Exempt Businesses

Microenterprises are explicitly exempt from accessibility obligations. A microenterprise is defined as a business that:

  • Has fewer than 10 employees;

  • Has annual turnover or balance sheet not exceeding €2 million.

What Happens After June 28, 2025

  • Service contracts signed before the deadline can remain valid until their expiration, for a maximum of five years;

  • Existing products already in lawful use before June 28, 2025, may continue to be used until June 28, 2030;

  • Self-service terminals (e.g., ticket machines) already operational before the deadline can be used until the end of their economic life, for a maximum of 20 years;

  • In case of non-compliance, providers must take immediate corrective actions and notify AgID.
